1. Acceptance of Terms

By accessing or using Open Art Collection ("the Service", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

Open Art Collection is a web-based tool that provides:

  • A modern interface for browsing public domain collections from the National Gallery of Art and The Metropolitan Museum of Art
  • Search and filtering capabilities for artwork, artists, themes, and styles
  • An image export tool for formatting artwork for TV displays (Samsung Frame TV and similar)
  • An upload feature allowing users to process their own images for TV display

Non-Commercial Nature

  • This is a completely free service - we do not charge for any features
  • We generate no revenue from this project - no advertisements, no subscriptions, no in-app purchases
  • This is a personal, open-source project - provided as a public service to make art more accessible
  • We make no money - this project is maintained at personal expense

3. No Ownership Claims

Important Disclaimer:

  • We do NOT own the National Gallery of Art or The Metropolitan Museum of Art collection data or images
  • We do NOT own any images uploaded by users
  • We do NOT claim any intellectual property rights over content displayed or processed through this Service
  • We merely provide a tool - an interface to browse public domain art and process images

3.1 Museum Collection Data

All artwork data and images from the National Gallery of Art and The Metropolitan Museum of Art are released under the Creative Commons Zero (CC0) 1.0 Universal license - Public Domain Dedication. This data is freely available from:

We have indexed and display this public domain data but claim no ownership or rights over it. Both museums retain all credit for making this data publicly available.

3.2 User-Uploaded Content

When you upload an image to our Service:

  • You retain all ownership rights to your uploaded content
  • We claim no ownership, license, or rights over your images
  • We only process your image temporarily to provide the requested service (cropping/resizing for TV format)
  • Your image is automatically deleted within 24 hours
  • We do not review, moderate, distribute, or use your images for any purpose other than providing the requested processing

4. User Responsibilities

When using the Service, you agree that:

4.1 Image Upload Requirements

Before uploading any image, you represent and warrant that:

  • You own the copyright to the image, OR
  • You have obtained all necessary permissions, licenses, or rights to use and modify the image
  • The image does not infringe upon any third party's intellectual property rights
  • You have the right to create derivative works (cropped/resized versions)

4.2 Prohibited Content

You agree NOT to upload:

  • Content that infringes copyright, trademark, or other intellectual property rights
  • Illegal content under applicable law
  • Malicious files, viruses, or harmful code
  • Content that is defamatory, obscene, or otherwise objectionable
  • Content depicting illegal activities

4.3 Accuracy of Declarations

By checking the rights confirmation box when uploading, you are making a legal declaration that you have the rights to use the image. You are solely responsible for the accuracy of this declaration.

5. Intellectual Property

5.1 Museum Collections (CC0 Public Domain)

The artwork data and images from both the National Gallery of Art and The Metropolitan Museum of Art are in the public domain under CC0. You may:

  • Use the artwork for any purpose, including commercial use
  • Modify, adapt, and create derivative works
  • Distribute and share freely
  • No attribution is required (though appreciated)

5.2 User Uploads

You retain full ownership of any images you upload. We receive only a limited, temporary license to:

  • Store your image temporarily (maximum 24 hours)
  • Process your image (crop, resize) as you request
  • Deliver the processed image to you

This license terminates automatically when your image is deleted (within 24 hours) or when you download the processed result, whichever comes first.

5.3 Website Interface

The website design, code, and interface are the work of the project creator. The project is open source and freely available.

6. Disclaimer of Warranties

Important Legal Notice

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We expressly disclaim all warranties including, but not limited to:

  • No warranty of availability: The Service may be unavailable, interrupted, or discontinued at any time without notice
  • No warranty of accuracy: Artwork data, metadata, and information may contain errors or inaccuracies
  • No warranty of quality: Image processing results may vary based on source image quality
  • No warranty of fitness: We make no guarantees that the Service will meet your specific requirements
  • No professional advice: Nothing on this Service constitutes legal, professional, or expert advice
  • No warranty of security: While we take reasonable precautions, we cannot guarantee absolute security

You use the Service at your own risk. We are not responsible for any decisions made based on information from this Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE OPERATORS, CREATORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This limitation applies to damages arising from:

  • Your use or inability to use the Service
  • Any unauthorised access to or alteration of your transmissions or data
  • Any content obtained from the Service
  • Loss of uploaded images or data
  • Service interruptions or downtime
  • Errors, inaccuracies, or omissions in content
  • Any other matter relating to the Service

Maximum Liability: Given that this is a free, non-commercial service from which we derive no revenue, our maximum aggregate liability to you for any claims arising from your use of the Service shall not exceed zero pounds sterling (£0). By using this free Service, you acknowledge and accept this limitation.

8. User-Generated Content

8.1 Limited License Grant

When you upload content to our Service, you grant us a limited, non-exclusive, royalty-free license solely to:

  • Store the content temporarily for processing
  • Process (crop, resize, convert) the content as you request
  • Transmit the processed content back to you

This license is strictly limited in scope and duration (maximum 24 hours). We acquire no other rights to your content.

8.2 No Review or Moderation

We do not pre-screen, review, or moderate user-uploaded content. You are solely responsible for the content you upload and any consequences arising from it.

8.3 Automatic Deletion

All uploaded content is automatically and permanently deleted within 24 hours. We have no ability to recover deleted content and make no backups of user uploads.

9. Third-Party Content and Services

9.1 Museum Data and Services

This Service relies on data and APIs from the National Gallery of Art and The Metropolitan Museum of Art. We are not affiliated with, endorsed by, or officially connected to either museum. Either museum may modify or discontinue their data/API access at any time, which could affect this Service.

9.2 Third-Party Infrastructure

We use third-party services (Cloudflare, Google Cloud, Supabase) to operate this Service. These providers have their own terms of service and privacy policies. We are not responsible for their actions or service interruptions.

9.3 External Links

The Service may contain links to external websites. We are not responsible for the content, privacy policies, or practices of third-party websites. Inclusion of links does not imply endorsement.

10. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to probe, scan, or test the vulnerability of the Service
  • Interfere with or disrupt the Service or servers/networks connected to it
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Attempt to circumvent any security measures
  • Impersonate any person or entity
  • Harvest or collect user information
  • Use the Service to transmit malware or harmful code
  • Overload, flood, or spam the Service

11. Termination and Modification

11.1 Right to Modify or Discontinue

We reserve the right, at our sole discretion, to:

  • Modify, suspend, or discontinue the Service at any time, with or without notice
  • Change features, functionality, or content without prior notice
  • Impose limits on certain features or restrict access to parts of the Service

11.2 No Obligation to Maintain Service

This is a free, personal project. We have no obligation to maintain, support, or continue operating the Service. We may cease operations at any time without liability.

11.3 Effect on User Content

If the Service is discontinued, any uploaded content will be deleted. Since all uploads are automatically deleted within 24 hours regardless, this should have minimal impact.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Service operators, creators, and contributors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you upload to the Service
  • Any misrepresentation regarding your rights to uploaded content

This indemnification obligation will survive termination of these Terms and your use of the Service.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provisions of these Terms, which shall remain in full force and effect.

The waiver of any breach of these Terms shall not constitute a waiver of any subsequent breach.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service.

These Terms supersede any prior agreements or understandings, whether written or oral, relating to your use of the Service.
